COURIER 05/ 13/ 2008 Union: ICE raid interfered with ongoing investigation By JOSH NELSON, Courier Staff Writer POSTVILLE --- Officials from a union attempting to organize workers at the Agriprocessors plant in Postville attempted to dissuade immigration officials from conducting a raid more than a week ago. Mark D. Lauritsen, international vice president of the United Food and Commercial Workers, sent U. S. Immigration and Customs Enforcement a letter on May 2 informing the agency that any planned immigration enforcement could disrupt an ongoing investigation into labor law violations at the plant. Union officials said the Iowa Department of Labor and the U. S. Department of Labor were investigating potential minimum wage and child labor laws. Workers for El Centro Latinoamericano processing detainees and their families all night in Postville reported a handful of underage male workers were released to them, the majority of them Guatemalan. Sholom Rubashkin, Agriprocessors vice president, said Agriprocessors is open today. Rubashkin denied that his company is violating any labor laws and said the UFCW is just trying to hurt them. " We are a serious economic power in this part of the country and it's being undermined," he said. The UFCW has been trying to organize workers at the Agriprocessors plant for more than a year. The letter said other employers have used ICE actions to abuse or intimidate employees before an election to decide whether to unionize, or blame the union for immigration actions. " With these labor disputes in progress, we urge you to suspend any potentially existing enforcement efforts and refuse to be involved in this labor dispute in accordance with the internal guidance ' Questioning Persons During Labor Disputes,' because ICE participation has the potential to deprive the workers of their guaranteed protected rights," Lauritsen wrote. Lauritsen said any action --- such as Monday's raid --- could have a " chilling effect" on the work force. He said the raid could scare off workers, thus hindering any investigation into violations of labor laws. The internal guidance policy urges ICE and Department of Labor officials to develop policies that would avoid " inappropriate worksite interventions" where it is suspected a labor dispute is occurring, according to the National Immigration Law Center. Union officials questioned the timing of Monday's raid since the letter alerted them of the pending investigation. Tim Counts, an ICE spokesman, said the operation was the result of several months of investigation and planning. " It was conducted in full compliance with ICE policies and procedures," Counts said. Iowa Labor Commissioner David Neil confirmed an investigation has been ongoing into wage and child labor law violations at the plant. Neil said he wasn't sure how Monday's actions would affect that inquiry. " I don't know at this point, but it's an ongoing investigation that is not complete yet," he said. Scott Frotman, a UFCW spokesman, said union officials hope Monday's action doesn't end the state and federal investigations into what they called " very serious, serious allegations." " We would hope they would continue to pursue the investigation and follow it where it will go," Frotman said. The union did not elaborate on what labor officials were looking into. Union organizers have heard bits and pieces of what was going on, Frotman said, but they weren't sure of the duration or the scope of the investigation. Officials from the U. S. Department of Labor and the Iowa Labor Services Division were unavailable for comment this morning. Messages left for ICE officials were not immediately returned. COURIER 05/ 13/ 2008 Undercover worker aided agents By JEFF REINITZ, Courier Staff Writer POSTVILLE --- Monday's immigration raid at Agriprocessors was the result of almost eight months of investigation, according to U. S. Attorney Matt Dummermuth. The probe included interviews with former illegal workers and an undercover source who landed a job at the plant and sometimes wore a recording device, court records show. The numbers alone are interesting. Agents with the Bureau of Immigration and Customs Enforcement said Agriprocessors had 833 workers with suspicious Social Security numbers pulling a paycheck in the third quarter of 2007. All 833 employees were found to have either used invalid Social Security numbers or numbers not their own, said an application ICE agents submitted to secure a search warrant of the facility. An ICE analysis of the numbers estimated that 76 percent of the 968 workers at Agriprocessors in the fourth quarter of 2007 were using bogus Social Security numbers. Agents sought criminal complaints and arrest warrants for 697 Agriprocessors employees. More than 300 were detained as of 2 p. m. Monday, officials reported, and buses continued to roll onto the National Cattle Congress grounds after dark. Wired About 12 of the search warrant application's 52 pages detail the efforts of a confidential source to get a job at Agriprocessors and what he saw inside. Referred to only as Source No. 7, the undercover operative first tried to get hired at the plant in early November without a Social Security card and was turned down. He then followed a tip that a certain supervisor would hire him without documents. During a meeting at the supervisor's house, he was told he should " fix" his Social Security number to be able to work. In December, Source No. 7 returned to the plant with a counterfeit Social Security card and a bogus permanent resident alien card provided by ICE agents. A human resources worker told him the numbers and name didn't match and again rejected him. The source talked to another person who was turned down for bad documents and received the phone number of a person in California who was supposed to be able to obtain good papers. The California man told the source that others who tried to pass the papers at Agriprocessors weren't successful because the company had become strict in its hiring process. Finally in January, ICE officials gave Source No. 7 a valid Social Security card to use while applying at the plant. The number was different from the bogus card he tried to pass in December, but he used the same name as before, according to court records. He was hired to hang cattle at the plant for $ 7.25 an hour --- minus $ 2 per week for mandatory safety equipment --- and then went on to wear a wire during orientation. The search warrant application described how a human resources employee instructed a group of new workers how to check the different boxes of their I- 9 employment eligibility form based on their citizenship status. At this point, the new employees began to laugh, records state. Source No. 7 continued his employment at Agriprocessors until at least April. During that time he heard that employees who didn't have good documents didn't use swipe cards and biometric devices that worked as electronic time cards. They also received paychecks that were a different color. In February, Source No. 7 told ICE agents about a incident where a floor supervisor duct- taped the eyes of a worker who was apparently an undocumented Guatemalan and hit him with a meat hook. " Source # 7 asked the Guatemalan to report this incident to the front office, but the Guatemalan stated that it would not do any good and could jeopardize his job," records state. The undercover source also heard about a character known only as " Mr. Boss," who was a Postville resident and was in charge of the different colored checks received by undocumented workers at the plant. Another source in the investigation was a former supervisor who said he was fired after breaking up a methamphetamine lab in the plant. He told of an incident where three employees had Social Security cards with the same number. COURIER 05/ 13/ 2008 State steps in to help Postville residents By Charlotte Eby, Courier Des Moines Bureau DES MOINES --- State officials are working to help Postville residents deal with the fallout of a raid by federal immigration officials Monday on kosher meatpacker Agriprocessors Inc. The raid netted close to 300 detainees and is being called the biggest federal raid of its kind in Iowa. Iowa Lt. Gov. Patty Judge said she hears concerns about the future of the plant and its jobs and said leaders would aim to get those questions answered. " We know that there's a lot of anxiety," said Judge, who is heading a working group of top state officials reacting to the raid. They had not yet talked to the owners of the plant Tuesday morning, Judge said. Postville families who are in the country lawfully also will be affected, Judge said. " There are many people that are employed there that are longtime residents of Postville, and so it is going to be difficult for them to pick up the pieces if the plant is dark for very long," Judge said. Judge was optimistic the small Northeast Iowa town, which has served as a draw for residents of diverse backgrounds, could rebound. " Postville always found a way to sort of make things work, and I'm sure that that resilience will be there, and they will do that again," Judge said. Because federal officials are leading the effort, the state is playing a support role to ensure residents in Postville have the things they need, Judge said. One of those roles is ensuring children are safe. Judge said reports found that all of the children of affected families had been housed with relatives or friends. No children needed to be taken into foster care, which Judge called " a real relief." " That was something we didn't want to do, but we knew that we would have to if necessary," Judge said. Iowa Department of Human Services spokesman Roger Munns said federal officials notified them by faxed letter when the raid was in progress. In Postville, every child was matched with an adult caretaker and the DHS was not asked to assist. " We were not called to protect a child," Munns said. If they are called in, the department will determine first if the child has a caretaker, and if not, if a family member can step forward. If no family members can help, the child would be placed in a foster home. An earlier raid on a meatpacking plant in Marshalltown resulted in no children ending up in foster care, Munns said. Attorney's office in Cedar Rapids said this morning Monday's raid at Agriprocessors in Postville is the largest enforcement operation at a single site in the United States in terms of the number of people administratively arrested. Most of the administrative arrests in the raid were Guatemalans but included four different nationalities, officials with the U. S. Attorney's office said. Of the estimated 390 detainees, 290 were Guatemalans and 93 were Mexicans, as well as a handful of Israelis and Ukrainians, officials said. Of those detainees, 314 were male, 76 were female. Twelve were juveniles, officials said. Officials said many of the individuals are being held in Estel Hall on the National Cattle congress grounds. Intake processing was occurring at McElroy Auditorium. An immigration attorney gained was allowed access to the National Cattle Congress grounds late this morning. Meanwhile Efforts to bring families currently staying in a Catholic church in Postville closer to detained family members and legal aid was underway this morning at El Centro Latinoamericano. The Guatemalan consulate in Chicago said this morning it is sending two representatives to the center this evening. The Latino resource center is coordinating with area churches and St. Bridget's Catholic Church in Postville to transport people down to shelters in Waterloo. COURIER 05/ 13/ 2008 ICE raid is largest ever in Iowa By JEFF REINITZ and JENS MANUEL KROGSTAD, Courier Staff Writers WATERLOO - It all happened so quickly, yet many believed all along that what federal officials were doing at National Cattle Congress for the past week was preparing for exactly what took place. As the sun rose Monday morning, a flurry of activity at the National Cattle Congress grounds led to what officials are calling the largest immigration raid in Iowa history. Federal agents converged on the grounds of the Agriprocessors meat- packing plant in Postville at 10 a. m., rounding up Hispanics on investigations of identity theft, use of stolen Social Security cards and for people in the county illegally. As many as 300 people were arrested, although some were later released. Workers for El Centro Latinoamericano in Postville said dozens of people slept overnight at St. Bridget Catholic Church, which became a gathering point for families of those arrested, as well as a handful who were conditionally released until a court hearing. They also reported that federal officers dropped off at the church at least one minor who was arrested in the raid. Authorities weren't just looking for illegal workers. Immigration agents sought to seize Agriprocessors' computer system including CDs and other data storage devices, according to the records ICE officials filed in applying for a search warrant of the plant. Agents were also looking for data from " biometric" devices that allowed workers to clock in and out by scanning their hands. ICE officials said they should have most or all of the detainees relocated from the fairgrounds by late Wednesday or Thursday. " Our priority is to ensure the safety and security of everyone involved," ICE spokeswoman Barbara Gonzalez told reporters at a staging area near the Electric Park Ballroom Monday afternoon. Gonzalez said the NCC would be used by ICE as an " intake center," where those arrested would have their photographs and fingerprints taken and get put into a database. From there, the men would be housed in NCC's Estel Hall while the women would be housed temporarily in " local jails." She would not specify which jails would take in the women. Gonzalez said everyone's rights were being protected. " We do have medical centers ... shower facilities, recreational facilities, three meals a day, snacks," she said. " We felt ( the National Cattle Congress) was an adequate facility to house them for their safety and security." The National Cattle Congress grounds in Waterloo was rented by federal officials for the entire month of May. When the feds closed off the NCC grounds May 3, there was little word on what their work there was to entail. Many thought they were participating in Homeland Security drill to prepare for a natural or other disaster. But others, including area Hispanics, believed that an immigration raid was imminent. The raid by agents from U. S. Immigration and Customs Enforcement was the largest such operation in Iowa history, said Matt M. Dummermuth, U. S. Attorney for the Northern District of Iowa. He said the raid at the Agriprocessors Inc. plant was part of an investigation that started in October and came after months of planning. Agriprocessors is the world's largest kosher meatpacking plant. In addition to detaining workers, ICE agents sought to seize Agriprocessors' computer systems and CDs for forensic analysis, according to court records. They also looked for identification documents and data " biometric" devices the workers use to clock in and out. Such information could be evidence of harboring aliens, records state. The detainees were being taken to the National Cattle Congress grounds according to Barbara Gonzalez and ICE spokeswoman, where agents had set up a an " intake center." Male detainees will be held there until at least Thursday. Female detainees were to be housed in local jails. About 300 people were detained, but at least 44 were quickly released for " humanitarian reasons," mainly so they could care for their children, said Claude Arnold, special agent in charge of the ICE office of investigation in Bloomington, Minn. They were released on the condition they appear before an administrative judge at a later date, Arnold said. Immigration proceedings are still pending against those people, officials said. " ICE is committed to enforcing the nation's immigration laws in the workplace to maintain the integrity of the immigration system," Arnold said in a press release. " We carry out that obligation in a fair and responsible manner, ensuring humanitarian needs are taken into consideration." Court records allege immigration officials have criminal complaints on file for 695 people in connection with the investigation. All those taken into custody would be interviewed by ICE agents and public health officers to find out if they have health, caregiver or humanitarian concerns, according to a release from the U. S. Justice Department. Those arrested will face criminal and civil charges including identity theft, improper use of Social Security data and other crimes. About 1,000 to 1,050 people work at the plant, according to Iowa Workforce Development. Sholom Rubashkin, Agriprocessors vice president, declined to release any information about the raid. " Right now there is no comment," Rubashkin said. The U. S. District Court for the Northern District of Iowa will be temporarily relocated to the Electric Park Ballroom on the NCC grounds in anticipation of the arrests, according to a release from the court. Chief Judge Linda Reade made the decision to make it easier for the families of those arrested and because of the scope of the operation, the release said. Courtrooms in Cedar Rapids and Sioux City weren't big enough to hold and process those arrested. The move will have a substantial effect on court operations in the Northern District. Jeff Giertz, a spokesman for U. S. Rep. Bruce Braley, D- Waterloo, said ICE officials notified Braley's office about a half hour after the raid started. ICE described the raid as a " targeted enforcement action," Giertz said. " Basically they explained it they'd been investigating whatever violations in advance and they were looking for specific people," he said. ICE agents and medical professionals are evaluating those detained, Counts said. Those in need of medical care could be conditionally released, while awaiting appearance in immigration court. A toll- free hotline was set up by ICE for family and friends of those arrested at 1 ( 866) 341- 3858. In Waterloo, school administrators said they have yet to see any backlash from the Monday morning raids in Postville. No widespread absences had been reported. However, administrators, who are attending a meeting in Des Moines today, are keeping close tabs on the situation and preparing for any possible impact on students and their families. " We have heard the rumors and received information about the raid in Postville. We are always cognizant how it could affect our families. Our job is to help children cope and deal with difficult situations," said Sharon Miller, director of schools and community relations. " With any student who is facing a major concern we want to be there to provide support because what affects families affects our children and our schools." COURIER 05/ 13/ 2008 Dozens protest immigration raid By JENS MANUEL KROGSTAD, Courier Staff Writer WATERLOO - More than 150 people marched Monday night in a peaceful but raucous protest outside of National Cattle Congress. For two hours, demonstrators marched, chanted and waved flags along the sidewalk that runs along NCC grounds, where detainees from the immigration raid in Postville were being held. At times, they turned towards federal agents on the other side of the barbed wire fence to chant slogans like " ICE go home." But they reserved their most passionate, throatiest protests for when buses, presumably carrying detainees, pulled into the grounds. " When something like this happens, it hits home," said Gloria Wickham, a native of Mexico. Tensions rose at several points during the demonstration, and emotions sometimes boiled over. About half of the crowd were young protesters who arrived to express their anger over the raids. They generally yelled the loudest, and at times shook the NCC's fencing. " We work hard, we stay out of trouble, and they want to take us away?" said Cesar Bravo, 18, a student at Waterloo West High School. " When they hit Tama ( County) in a raid, they took my uncle. They ruin our families." Veronica Retuer- Villagrana, 17, said she was upset because most illegal immigrants stay out of trouble. " We come here to work, not be criminals," she said. Protestors originally set up across the street from the detention facility, but were forced to move when a representative of Culligan Water Outlet complained they were on private property. A man, who identified himself as the owner of the Culligan business but refused to give his name, exchanged heated words with Mario Basurto, program coordinator at El Centro Latinoamericano. " What are you protesting with the American flag for?" the man said. After demonstrators were told they had to move, they marched in a circle on Ansborough Avenue, blocking traffic for a few minutes. Around that time several police cars arrived to help control the crowd. Shortly thereafter, leaders of the protest met with police then told the group to move to the sidewalk or risk arrest. As the sun set, four counter- protesters set up across the street flying an American flag. After exchanging shouts across Ansborough Avenue, police asked them not to antagonize the crowd. But when the protestors spotted their flag they yelled, " Hey, did you know your flag is backwards?" The counter- protesters quickly flipped it around. Eric Fosselman said he even though he didn't agree with what the people were protesting, he didn't have a problem with them because they were probably legal residents. " The people over there, they're not illegals - they can be here," he said. By about 10 p. m., representatives of El Centro Latinoamericano were already planning how to deliver legal aid to detainees the next day. They talked with Immigration and Customs Enforcement agents through the fencing to figure out how to send lawyers into the facility Tuesday morning. COURIER 05/ 13/ 2008 Detainees heading to court this afternoon By JOSH NELSON, Courier Staff Writer WATERLOO - Court proceedings against approximately 390 people detained in the largest immigration raid of its type are scheduled to begin this afternoon. Agents from the U. S. Immigration and Customs Enforcement descended on the Agriprocessors plant in Postville Monday morning. The 390 people arrested, most of whom were Guatemalan immigrants, were transported to a processing area at the National Cattle Congress fairgrounds in Waterloo. Fifty- six people were released on humanitarian grounds, either from health conditions or because children would be left without parents. Most of those were women. " Very few women remain in custody," said Claude Arnold, a special agent in charge of the ICE office of investigations in Bloomington, Minn. Seventy- six women were arrested in all. Three hundred and fourteen men are being held at Estel Hall on the fairgrounds. Three temporary court rooms were set up at the fair by the U. S. District Court of the Northern District of Iowa, where the defendants who face criminal charges will make their initial appearance, said U. S. Attorney Matt M. Dummermuth. The hearings are expected to begin at 4 p. m., according to court documents. Attorney Steve Swift has been appointed to represent the first 10 defendants. After that appearance, the defendants will be remanded to the custody of the U. S. Marshals. Those not criminally charged will stay in the custody of ICE while they undergo deportation proceedings, officials said. The defendants may face a range of charges, including aggravated identity theft and fraudulent use of a social security number. Officials said the raid was the largest single- site raid in the nation, and the largest in Iowa's history. At a press conference earlier in the day, ICE officials showed a video of the processing area, which included enough space for nearly 700 people. The area included showers, sleeping arrangements and entertainment. " You can see this was not just a small operation," said Bob Teig, an assistant U. S. attorney. An intake processing area was set up in McElroy Auditorium. Most of the administrative arrests in the immigration raid at Agriprocessors in Postville were Guatemalans but included four different nationalities, officials with the U. S. Attorney's office in Cedar Rapids said this morning. Of the 390 detainees, 290 were Guatemalans and 93 were Mexicans, as well as a handful of Israelis and Ukrainians, officials said. Twelve juveniles who were found working at the plant were also arrested, Arnold said. Six of those juveniles were released to family members or other responsible adults. An immigration attorney gained was allowed access to the National Cattle Congress grounds late this morning. Meanwhile Efforts to bring families currently staying in a Catholic church in Postville closer to detained family members and legal aid was underway this morning at El Centro Latinoamericano. The Guatemalan consulate in Chicago said this morning it is sending two representatives to the center this evening. The Latino resource center is coordinating with area churches and St. Bridget's Catholic Church in Postville to transport people down to shelters in Waterloo. COURIER 05/ 13/ 2008 Culver expresses support for crackdown By CHARLOTTE EBY, Courier Des Moines Bureau DES MOINES --- Iowa Gov. Chet Culver has formed a working group of top state officials to help the community of Postville after a raid on its meatpacking plant by federal immigration officials Monday. Culver announced the action at a news conference Monday, just hours after officials descended on kosher meatpacker Agriprocessors. He expressed support for going after employers who hire illegal workers and in some cases, exploit them. Culver said his office was informed last week of the pending federal action and was notified once it was in progress. " I have said before that I believe it is important that we crack down on illegal immigration," Culver said. " Illegal means illegal, not just those who are crossing the border illegally, but also those who are responsible for helping to make it happen --- traffickers, identity thieves, those who knowingly hire illegal immigrants and anyone who has taken advantage of employees or turned a blind eye." Culver said at the same time, officials must make sure to protect the rights of the accused and ensure they are afforded due process. " My administration has made it clear to the federal government the importance of ensuring the humanitarian side of this exercise is addressed, and I have received assurances from the federal government that they are doing so," Culver said. State officials from various departments will work to assist Postville in dealing with action, Culver announced. " While this is a federal exercise, my office will continue to keep the public and the press informed of any additional state involvement," Culver pledged. If criminal activity at the state level is discovered, Culver said the Iowa Division of Criminal Investigation is prepared to step in. " Most importantly, we want to enforce the federal law and the state law and hold those accountable for any illegal activity," Culver said. He said he was " very troubled" by the allegations. " That does not reflect well on Iowa businesses. So any criminal activity that is taking place by an Iowa business, allegedly in this case, is not a good signal, and I think those involved should be held accountable," Culver said. Iowa lawmakers this year considered measures to try to crack down on employers who hired illegal immigrants but ultimately failed to get one passed through both chambers before they adjourned for the year in April. The Postville raid and ICE actions " highlight once again the need for comprehensive immigration reform," said Dubuque Archbishop Jerome Hanus. " Families have been disrupted; parents and children are filled with fear. Many are uncertain whether their loved ones will be arrested, imprisoned indefinitely or deported." The Dubuque archdiocese covers the northeast quadrant of Iowa and includes Postville. " This state of terror for families is evidence that our political system has not adequately addressed the demand for labor, the inadequacies of our present immigration policies and practices, and the broader economic challenges," the archbishop said. " Some of the weakest members among us are bearing the brunt of the suffering, while legislators and other leaders, as well as many of us in the general public, have failed to give this issue the priority that it deserves," Hanus said.
